New digital-first adjudicatory body under DPDP Act to oversee data breaches and compliance

NEW DELHI: The Ministry of Electronics and Information Technology has invited applications for the posts of chairperson and members of the newly constituted Data Protection Board of India, marking a major step in operationalising India’s digital data protection framework.

Established under Section 18 of the Digital Personal Data Protection Act, 2023, the Data Protection Board of India has been set up as an independent adjudicatory authority tasked with enforcing provisions related to digital personal data protection and privacy compliance.

The government said the board has been designed as a “digital-by-design” institution, aligned with its broader push towards technology-enabled governance and transparent regulatory systems.

The board will consist of one chairperson and four members. Once operational, it will have powers to investigate personal data breaches and instances of non-compliance under the DPDP framework. It will also be authorised to issue directions for mitigation and remediation and impose monetary penalties in accordance with the Act and the DPDP Rules 2025.

The creation of the board is being closely watched by businesses, technology firms, digital platforms and legal experts, as it is expected to become the central enforcement authority for India’s evolving data protection regime.

The ministry has said details regarding eligibility conditions, qualifications, pay structure and application procedures are available on the official Ministry of Electronics and Information Technology website.

Applications in the prescribed format must be submitted to the deputy secretary (personnel), Ministry of Electronics and Information Technology, Electronics Niketan, CGO Complex, New Delhi, within 30 days from the publication of the advertisement in Employment News.

With the Data Protection Board now moving from legislation to implementation mode, India’s digital governance architecture is entering a new phase where accountability around personal data handling is expected to come under far sharper regulatory scrutiny.
