The Karnataka High Court has ruled that privately watching
obscene films does not constitute an offence under the Indian
Penal Code (IPC) and quashed the criminal proceedings that
had been lodged against three engineering college students
in Bangalore.
Justice
K Bhaktavasala of the HC had allowed a petition challenging
the criminal proceedings initiated by the 7th Additional Metropolitan
Magistrate against three engineering college students who
were caught watching porn (obscene) films on their personal
computer on 30 November 2005 by the police.
Justice
Bhaktavasala observed yesterday that it is not the prosecutions
case that the students possessed compact discs and obscene
content for the purpose of sale, distribution or circulation.
The
students were watching the film in their rented room when
they were caught. The 7th Additional Metropolitan Magistrate
had taken cognizance of the case and had initiated criminal
proceedings against the students.
