NEW DELHI: In the significant case of Sea TV versus Moon
TV, the Supreme Court today upheld the judgment passed last
year by TDSAT that a competing MSO cannot be the agent of
a broadcaster.
This is an important victory of Zee TV over rival Star, as
Sea TV, which has won the case, is an affiliate MSO of WWIL,
while rival Moon TV is an MSO allied with Star. The two MSOs
are rivals operating out of the same town, Agra.
This will immediately impact the ground-level operations and
create a level playing field for LCOs and MSOs alike by doing
away with the complex web of agents, legal sources opined.
Sea had applied for access to Star's channels two years ago,
and the broadcaster had said that they had given access to
Moon TV and Sea TV should get the signal from Moon TV.
However, Zee had intervened saying Sea TV was bound to be
given access and had claimed that a competing MSO (in this
case Moon TV) or an LCO cannot be an agent of a broadcaster,
which was the genesis of the case in which the Apex court
today upheld TDSAT's ruling.
